Terms of Service for Checkout Fields Pro
Effective date: April 14, 2026
These Terms of Service ("Terms") govern your access to and use of Checkout Fields Pro (the "App"), operated by Alex Marcone under the Otheriver brand ("we", "our", or "us").
By installing or using the App, you agree to these Terms.
1. Use of the App
Checkout Fields Pro allows Shopify merchants to create custom checkout fields, conditional logic, validation rules, and flexible data storage behavior.
You may use the App only in connection with a valid Shopify store and in compliance with Shopify’s terms, policies, and all applicable laws and regulations.
2. Merchant Responsibilities
You are responsible for:
- configuring the App correctly for your business needs
- ensuring that any data collected through checkout complies with applicable laws and regulations
- maintaining the accuracy of the content, labels, logic, and conditions you create in the App
- ensuring that your use of the App does not violate Shopify policies or third-party rights
3. Billing and Subscription
If the App is offered on a paid subscription basis, charges will be billed through Shopify in accordance with the pricing terms presented at the time of approval.
Unless otherwise stated, subscription charges are recurring and non-refundable except where required by law or Shopify policies.
4. Availability and Changes
We may update, improve, modify, suspend, or discontinue any part of the App at any time.
We do not guarantee uninterrupted availability or error-free operation at all times.
5. Support
We provide support for the App through the support contact methods listed on our website or app listing.
We aim to respond within 1–2 business days, but response times are not guaranteed.
6. Data and Privacy
Your use of the App is also governed by our Privacy Policy.
7. Intellectual Property
All rights, title, and interest in and to the App, including software, design, content, trademarks, and related materials, remain the property of Alex Marcone and/or applicable licensors.
You may not copy, reverse engineer, resell, distribute, or misuse the App except as permitted by law.
8. Disclaimer
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
We do not guarantee that the App will meet every business requirement or operate without interruption or error.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from the use of the App.
Our total liability for any claim relating to the App will not exceed the amount paid by you for the App during the 12 months preceding the claim.
10. Termination
We may suspend or terminate access to the App if you violate these Terms or if required for legal, operational, or security reasons.
You may stop using the App at any time by uninstalling it from your Shopify store.
11. Governing Law
These Terms are governed by the laws of Italy, without regard to conflict of law principles.
