1. Provider and acceptance

These Terms govern the use of Otheriver RentQuote (the "App"), provided by Otheriver, operated by Alex Marcone, Via Primo Riccitelli 3, 64100 Teramo, Italy, VAT number 02172620672. By installing or using the App, the merchant accepts these Terms and confirms that they are authorized to bind the Shopify store.

2. Service

The App turns a Shopify storefront into a rental catalogue, hides or replaces purchase-oriented elements according to merchant settings, collects non-binding rental quote requests, creates or manages related Shopify customer and draft-order records, and provides merchant and customer request interfaces.

The App is a quote-request tool, not a booking calendar, inventory reservation system, rental contract, payment processor or guarantee of product availability.

3. Quotes and merchant responsibility

A customer submission is only a request. The merchant is solely responsible for checking availability, pricing, taxes, deposits, delivery, collection, damage terms, insurance, age restrictions, cancellations and all other rental conditions. A binding rental agreement exists only when the merchant and customer separately agree to it.

The merchant must provide accurate storefront information, configure the App appropriately, respond to customers, comply with consumer, tax, privacy and rental laws, and obtain any required consents. The merchant must not use the App for unlawful, deceptive, harmful or rights-infringing activity.

4. Subscription and trial

Where offered, the standard plan is USD 14.99 per month with a 7-day free trial. Development and Shopify Partner test stores may use the App without charge. Charges are processed through Shopify Billing and renew until cancelled. Uninstalling or cancelling before the next billing date prevents future renewals; fees already incurred are handled according to Shopify's billing rules and applicable law.

5. Data and privacy

Use of the App is subject to the Otheriver RentQuote Privacy Policy. The merchant is the controller of customer quote data and instructs Otheriver to process it to provide the App. The merchant must publish an appropriate customer privacy notice and respond to applicable data-rights requests.

6. Shopify and third parties

The App depends on Shopify and may depend on infrastructure providers such as Railway. Their services, availability and terms are outside Otheriver's control. The merchant must maintain an eligible Shopify store and comply with Shopify's terms.

7. Intellectual property

Otheriver retains all rights in the App, software, branding, documentation and original materials. The merchant receives a limited, non-exclusive, non-transferable and revocable right to use the App while the subscription or authorized test use remains active.

8. Availability, changes and support

We may maintain, update, secure, modify or discontinue features to improve the App or meet legal and Shopify requirements. We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Support requests can be sent to apps@otheriver.com.

9. Disclaimer and liability

To the maximum extent permitted by law, the App is provided "as is" and "as available". Otheriver is not a party to rental transactions and is not responsible for a merchant's products, pricing, availability, customer communications, rental contracts or legal compliance. Otheriver is not liable for indirect, incidental, special or consequential loss, loss of profits, revenue, data or goodwill. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Suspension and termination

We may suspend or terminate access for material breach, unlawful use, security risk, non-payment or Shopify platform requirements. On termination, the merchant must stop using the App. Data is handled according to the Privacy Policy and mandatory Shopify privacy webhooks.

11. Governing law and contact

Questi Termini disciplinano l'uso di Otheriver RentQuote (l'"App"), fornita da Otheriver, attività di Alex Marcone, Via Primo Riccitelli 3, 64100 Teramo, Italia, P. IVA 02172620672. Installando o utilizzando l'App, il merchant accetta i Termini e conferma di essere autorizzato a vincolare il negozio Shopify.

2. Servizio

L'App trasforma uno storefront Shopify in un catalogo di noleggio, nasconde o sostituisce gli elementi orientati all'acquisto secondo le impostazioni del merchant, raccoglie richieste non vincolanti, crea o gestisce i relativi clienti e ordini preliminari Shopify e fornisce interfacce per merchant e clienti.

L'App è uno strumento di richiesta preventivo, non un calendario prenotazioni, un sistema di prenotazione inventario, un contratto di noleggio, un processore di pagamenti o una garanzia di disponibilità.

3. Preventivi e responsabilità del merchant

L'invio del cliente costituisce solo una richiesta. Il merchant è l'unico responsabile di verificare disponibilità, prezzi, imposte, cauzioni, consegna, ritiro, danni, assicurazione, limiti di età, cancellazioni e ogni altra condizione di noleggio. Un contratto vincolante nasce solo quando merchant e cliente lo concordano separatamente.

Il merchant deve fornire informazioni corrette, configurare adeguatamente l'App, rispondere ai clienti, rispettare le norme su consumatori, imposte, privacy e noleggio e ottenere i consensi necessari. È vietato usare l'App per attività illegali, ingannevoli, dannose o lesive di diritti.

4. Abbonamento e prova

Ove disponibile, il piano standard costa 14,99 USD al mese con 7 giorni di prova gratuita. I development store e i negozi test Shopify Partner possono usare l'App gratuitamente. Gli addebiti sono gestiti tramite Shopify Billing e si rinnovano fino alla cancellazione. La disinstallazione o cancellazione prima della successiva data di fatturazione impedisce futuri rinnovi; gli importi già maturati seguono le regole Shopify e la legge applicabile.

5. Dati e privacy

L'uso dell'App è soggetto alla Privacy Policy di Otheriver RentQuote. Il merchant è titolare dei dati delle richieste e incarica Otheriver di trattarli per fornire l'App. Il merchant deve pubblicare un'informativa adeguata e rispondere alle richieste degli interessati previste dalla legge.

6. Shopify e terze parti

L'App dipende da Shopify e può dipendere da fornitori infrastrutturali come Railway. Servizi, disponibilità e condizioni di tali fornitori sono fuori dal controllo di Otheriver. Il merchant deve mantenere un negozio Shopify idoneo e rispettare i termini Shopify.

7. Proprietà intellettuale

Otheriver conserva tutti i diritti sull'App, sul software, sul marchio, sulla documentazione e sui materiali originali. Il merchant riceve un diritto limitato, non esclusivo, non trasferibile e revocabile di usare l'App finché l'abbonamento o l'uso test autorizzato restano attivi.

8. Disponibilità, modifiche e assistenza

Possiamo mantenere, aggiornare, proteggere, modificare o interrompere funzionalità per migliorare l'App o rispettare obblighi legali e Shopify. Puntiamo a un servizio affidabile, ma non garantiamo funzionamento ininterrotto o privo di errori. Assistenza: apps@otheriver.com.

9. Esclusioni e responsabilità

Nella misura massima consentita dalla legge, l'App è fornita "così com'è" e "come disponibile". Otheriver non è parte dei contratti di noleggio e non risponde di prodotti, prezzi, disponibilità, comunicazioni, contratti o conformità legale del merchant. Otheriver non risponde di danni indiretti, incidentali, speciali o consequenziali, perdita di profitti, ricavi, dati o avviamento. Nulla esclude responsabilità che non possono essere escluse per legge.

10. Sospensione e cessazione

Possiamo sospendere o cessare l'accesso per violazione sostanziale, uso illecito, rischio di sicurezza, mancato pagamento o requisiti Shopify. Alla cessazione, il merchant deve interrompere l'uso dell'App. I dati sono gestiti secondo la Privacy Policy e i webhook privacy obbligatori Shopify.

11. Legge applicabile e contatti
