This notice explains how we process personal data when you visit otheriver.com or contact Otheriver about information, services and projects. Otheriver applications have separate notices, available in the app privacy centre. The Checkout Fields Pro notice concerns that application and remains separate from this website notice.

1. Controller and contact details

The data controller is Alex Marcone, trading as Otheriver, based at Via Primo Riccitelli 3, 64100 Teramo (TE), Italy, VAT number 02172620672. For privacy information or to exercise your rights, email apps@otheriver.com.

2. Data we process

Browsing: technical information such as your IP address, browser, device, requested pages, access times, identifiers and session preferences. This information is used by the platform functions described below.

Enquiries: the contact form requires your name, email and message; company and phone number are optional. We also process information you choose to provide by contacting us directly or continuing a conversation about a project. Please avoid sending passwords, payment details or sensitive information that is unnecessary for your enquiry.

3. Purposes and legal bases

  • Enquiries and proposals: understanding your project, responding and preparing a proposal. For precontractual steps requested by the individual, the basis is GDPR Article 6(1)(b). For general correspondence and company representatives, it is our legitimate interest in managing professional communications, Article 6(1)(f).
  • Operation and security: making the website available and addressing spam, abuse and technical problems, based on our legitimate interest in protecting the service, Article 6(1)(f).
  • Legal obligations: meeting applicable legal requirements, Article 6(1)(c).
  • Measurement, personalisation and advertising using non-essential tools: consent where required, Article 6(1)(a), managed through your privacy choices.

Otheriver reviews project enquiries and arranges any further discussion through direct contact.

4. Providing your data

Contacting us is optional. Required fields allow us to receive and handle your enquiry: the form cannot be submitted without them. Optional information helps us understand the context. Sending an enquiry does not subscribe you to promotional communications.

5. Providers and recipients

The website is hosted by Shopify, which also provides the contact form and platform services. We use email services to receive and manage correspondence. Forms integrate hCaptcha, provided by Intuition Machines, Inc., to address automated access: the service may process technical information and device interactions. See the hCaptcha privacy notice.

Where necessary, authorised people and providers of IT, maintenance, security, email and professional advisory services may access data, according to their respective roles and agreements. Data may also be disclosed to authorities where required by law.

6. Shopify Network Intelligence

Shopify Network Intelligence is enabled. Shopify processes information about activity on this website alongside information about interactions with other merchants and Shopify to provide enhanced analytics, personalisation and advertising services. This may involve sharing information with Shopify and third parties located in other countries.

For these services Shopify also acts as a data controller: its purposes, legal bases and your rights are described in the Shopify Consumer Privacy Policy. You can manage choices relating to Shopify through the Shopify privacy portal.

7. Cookies and privacy choices

The website uses cookies and similar technologies for technical functions, preferences, measurement and the services described above. Consent is requested for non-essential tools in the relevant regions, including the European Economic Area. The Shopify banner lets you accept, reject or customise the available categories; you can review your choices from the banner when available. To display it again, you can delete cookies for otheriver.com in your browser settings and reopen the website; this also resets other preferences stored in those cookies.

The Shopify Cookie Policy lists platform cookies, purposes and lifetimes; not all apply to every visit or feature. For example, Shopify lists one year for _tracking_consent, which remembers privacy preferences. The Data sharing opt-out page is also available in the regions where it applies, alongside the Shopify portal linked above.

8. International transfers

Providers may process data outside the European Economic Area. The Shopify Data Processing Addendum governs transfers through binding corporate rules, adequacy decisions and standard contractual clauses, as applicable. hCaptcha is provided by a US company whose notice describes the applicable Data Privacy Framework and standard contractual clauses. European hosting does not exclude other international processing. You can request information about safeguards by contacting the controller.

9. Retention

Enquiry data is retained until the requested exchanges and activities conclude, taking account of project complexity, the validity of any proposal and ongoing discussions. Once an enquiry has concluded without an engagement, the need to retain data for that purpose ends, except for legal obligations or documented needs to protect legal rights.

If an engagement begins, necessary data is retained to manage it and meet subsequent administrative obligations and legal rights requirements. Technical data retention depends on operational and diagnostic needs and the completion of investigations into any abuse or incidents. Cookie lifetimes are described in the documentation linked above.

10. Your rights and updates

Where the GDPR applies, you may request access, rectification, erasure and restriction; you may object to processing based on legitimate interests on grounds relating to your situation. Portability concerns data you provided that is processed automatically on the basis of consent or a contract. You can withdraw consent without affecting the lawfulness of earlier processing.

Email apps@otheriver.com to exercise your rights. You may also complain to the Italian Data Protection Authority or the competent authority in your EU country. We update this notice when processing changes; the date at the beginning identifies the published version.
