FormSwitch Terms of Service

These Terms of Service ("Terms") govern access to and use of FormSwitch (the "App"), provided by Otheriver Apps. By installing or using the App, the merchant agrees to these Terms. Questions may be sent to apps@otheriver.com.

The service

The App lets merchants create, style, publish, and manage conditional forms for compatible Shopify themes and receive responses submitted through those forms. Features may evolve as the App is maintained.

Merchant responsibilities

The merchant is responsible for its Shopify store, form content, requested information, storefront notices, legal basis or consent, and use of submitted responses. The merchant must not use the App for unlawful, deceptive, harmful, infringing, or abusive activity, to collect data it is not authorized to collect, or to transmit malicious code. The merchant must keep its Shopify account secure and comply with Shopify's terms and applicable laws.

Plans and billing

Paid plans are offered and billed through Shopify. Current prices, billing intervals, plan limits, and applicable taxes are shown on Shopify's plan selection or approval screen and control if they differ from other descriptions. Plan limits apply to the number of simultaneously published forms. Charges, upgrades, downgrades, cancellations, and refunds are handled under Shopify's billing system and applicable policies. Uninstalling the App stops future App use but does not itself alter charges already incurred or due.

Merchant content and submitted responses

The merchant retains its rights in form content and submitted responses. The merchant grants Otheriver Apps a limited right to host, process, transmit, and display that content only as needed to provide, secure, support, and maintain the App. The merchant represents that it has the rights and permissions necessary for the content and processing it configures.

Our intellectual property

The App, its software, design, documentation, and branding are owned by Otheriver Apps or its licensors and are protected by applicable intellectual property laws. These Terms grant only a limited, revocable, non-transferable right to use the App with the merchant's Shopify store while the applicable plan remains active.

Availability and changes

We aim to operate the App reliably but do not guarantee uninterrupted or error-free availability. We may change, suspend, or discontinue features when reasonably necessary for maintenance, security, legal compliance, provider changes, or product development. Where practical, material changes will be communicated through the App or the contact information available to us.

Termination

The merchant may stop using the App by uninstalling it. We may suspend or terminate access for non-payment, material breach, security risk, unlawful use, or where required by Shopify or law. On uninstall or termination, access ends and store data is handled as described in the Privacy Policy.

Disclaimers and liability

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties not expressly stated in these Terms. Otheriver Apps is not responsible for Shopify, themes, third-party services, merchant content, or how merchants use submitted information. To the maximum extent permitted by law, Otheriver Apps will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, or lost data. Any aggregate liability relating to the App will not exceed the App fees paid by the merchant during the three months before the event giving rise to the claim. These limitations do not apply where exclusion or limitation is prohibited by law.

General terms

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. The merchant may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the App. Applicable mandatory consumer or commercial laws remain unaffected. Disputes will be governed by the laws applicable at Otheriver Apps' principal place of business, without limiting rights that cannot lawfully be waived.

Changes to these Terms

We may update these Terms to reflect service, legal, or operational changes. Continued use after the updated Terms take effect constitutes acceptance where permitted by law.
