Privacy Notice — Project Enquiry Questionnaire

This notice explains how Otheriver processes personal data collected through the project enquiry questionnaire available on otheriver.com. The questionnaire takes approximately five minutes and uses conditional questions to display only fields relevant to the answers already provided.
1. Data controller
The data controller is Alex Marcone, Otheriver, an independent studio operating from Teramo, Italy.

2. Scope of this notice
This notice applies to people who complete the questionnaire to describe a project, request a preliminary assessment or book a meeting with Otheriver. It does not replace the website’s general privacy or cookie information, or any notice applying to a later contractual relationship.
3. Data we collect
Depending on the route followed through the questionnaire, we may collect:
- identity and contact details: name, surname, email address, telephone number and other contact details voluntarily provided;
- professional information: company, organisation, role, industry and website;
- current situation: platforms, websites, ecommerce stores, apps, systems or processes already in use;
- project information: problems, objectives, expected outcomes, requested features, integrations and services;
- available materials: existing content, documents, data or resources, without requesting credentials or confidential information;
- budget and timing: investment range, priorities and desired delivery date;
- free-text notes: messages and other information voluntarily entered;
- booking information: date, time, contact details and information required for a calendar invitation when a call is booked;
- technical data: request metadata and server logs required for operation, security and error diagnosis.
Do not enter special-category personal data, identity documents, credentials, payment details or other confidential information that is not necessary to assess the project.
4. Purposes and legal bases
We use the data to:
- receive, understand and assess the enquiry;
- check the preliminary compatibility of the project with Otheriver’s services;
- contact the representative, ask for clarification and propose next steps;
- organise a meeting where available;
- retain the context of the enquiry and avoid duplicates;
- protect the questionnaire against abuse and resolve technical issues;
- manage applicable legal obligations or requests.
The main legal basis is taking steps at the data subject’s request prior to entering into a contract under Article 6(1)(b) GDPR. Organising enquiries, preventing abuse and protecting the service may also rely on Otheriver’s legitimate interests under Article 6(1)(f), taking account of the data subject’s rights and freedoms. Applicable legal obligations rely on Article 6(1)(c).
Any future marketing will be based only on separate, optional and unticked consent. Submitting the questionnaire does not automatically subscribe the person to promotional communications.
5. Conditional logic and human review
Visible questions change according to earlier answers. Configured rules can recognise enquiries that clearly match the type of project handled by Otheriver and immediately display the option to book a call.
Every submission is nevertheless reviewed manually by Alex Marcone. Uncertain cases and enquiries not routed directly to the calendar are assessed manually before the next step is decided. The questionnaire logic organises the commercial journey, but does not make decisions producing legal or similarly significant effects based solely on automated processing.

6. Required and optional information
Fields marked as required are necessary to submit and understand the enquiry. Without this information, we might be unable to assess it or contact you. Other fields are optional and provide additional context.
7. FormSwitch and questionnaire infrastructure
The questionnaire is managed through FormSwitch, an app developed and operated by Otheriver. Responses are normalised and stored as structured records in a PostgreSQL database associated with the form.
FormSwitch uses Shopify for website integration and signed app proxy requests to communicate with the service. The app and database are hosted through Railway. The verified project documentation and public form module do not show FormSwitch-specific advertising or analytics cookies.
At the date of this notice, the inspected FormSwitch version does not automatically email a copy of the responses. Data is stored in the app’s structured record and accessed by Alex Marcone. If a notification system that transmits enquiry content to an email account is enabled, this notice will be updated before activation.

8. Google booking and meetings
Where the route allows a booking, Otheriver uses Google Appointment Schedules, Google Calendar and Google Meet through a personal account controlled by Alex Marcone. Google processes the information needed to display availability, create the event, send an invitation and provide the meeting link.
Otheriver does not record or transcribe a call without informing participants in advance and identifying an appropriate legal basis. Use of Google services is also subject to the Google Privacy Policy.
9. Who can access the data
Operational access to enquiries is restricted to Alex Marcone. Data may also be processed by providers strictly necessary for the workflow:
- Shopify, for the website and app proxy integration;
- Railway and its database infrastructure, for FormSwitch hosting;
- Google, when the booking and meeting route is used.
Otheriver does not sell the data or use responses for third-party advertising.
10. International transfers
Technical providers may process data outside the European Economic Area. Railway states that services may be hosted or operated in the United States and other regions and describes the applicable transfer mechanisms in its privacy notice. Google and Shopify describe their respective transfers and safeguards in their policies and terms.
The effective Railway deployment region used by FormSwitch is not displayed in the public questionnaire interface; we therefore do not claim that data is stored exclusively within the European Union.
11. Retention and deletion
For prospects who do not become clients, Otheriver retains questionnaire data for no longer than six months from the last substantive contact. If no contact follows the submission, the period runs from the questionnaire submission date.
Automatic six-month deletion is not yet available in the verified FormSwitch version. Until it is implemented, Alex Marcone performs a periodic manual review of records and deletes or irreversibly anonymises those that reach the deadline. Deleting a form also deletes its related submissions; uninstalling the app removes the store’s forms, submissions and sessions from the active service.
Data relating to enquiries that become client relationships may be retained for longer where necessary to manage that relationship, comply with administrative obligations or establish and defend legal claims. Limited technical copies may temporarily remain in provider backups or logs until the relevant retention cycles expire.
12. Cookies and similar technologies
The verified public FormSwitch module does not set its own advertising or analytics cookies and does not use local storage to retain responses. The Shopify website and Google pages used for booking may use cookies or similar technologies according to their configurations and notices. Website preferences are managed through the tools and cookie information available on otheriver.com.
13. Security
The verified flow uses encrypted connections, signed Shopify app proxy requests, payload validation and size limits, and store-level data separation. No transmission or storage system can guarantee absolute security.
14. Your rights
Where provided by applicable law, you can request access, correction, deletion, restriction, portability or object to processing. You can also withdraw consent without affecting processing carried out before withdrawal.
To exercise these rights, email apps@otheriver.com and provide enough information to identify the enquiry. You may also lodge a complaint with the Italian Data Protection Authority.
15. Optional marketing
The questionnaire does not automatically subscribe people to newsletters or promotional communications. If this option is added in the future, it will use a separate, optional and unticked choice. Refusing consent will not prevent submission or assessment of the enquiry.
16. Changes
This notice will be updated when the questionnaire, providers, purposes, routing logic, notification system or retention procedures change. The date at the beginning identifies the current version.
